Le presenti condizioni generali definiscono e disciplinano le modalità ed i termini in base ai quali il Comune di Padova mette a disposizione dei cittadini il servizio di rete senza fili, denominato Padovaweb.

1. Descrizione e caratteristiche del servizio

1. Il servizio Padovaweb (di seguito servizio) consente di accedere a titolo gratuito, senza alcun onere e/o costo di installazione per l'utente, alla rete Internet in modalità WI-FI, senza fili (Wireless Fidelity), solo nelle aree cittadine appositamente abilitate.
2. Il servizio può essere utilizzato dall’utente, residente o meno nella città di Padova, con proprie apparecchiature portatili (PC, smartphone, ecc.) compatibili e dotate di scheda di rete certificata dal marchio WI-FI; opportunamente configurate. Resta pertanto a carico dell'utente l'onere di dotarsi a proprie cura e spese della strumentazione tecnica necessaria per accedere al servizio.
3. Il servizio è fornito con gli obblighi di sicurezza applicabili, mediante l’utilizzo di frequenze in banda condivisa e senza protezione da interferenze: dunque l'erogazione del servizio e la sua qualità non sono garantite. Il servizio è fornito con rete libera, non protetta da crittazione del traffico. Se ne sconsiglia pertanto l’utilizzo in caso di comunicazioni contenenti dati con carattere di riservatezza.
4. Alla connessione, l'utente deve aver attentamente letto ed espressamente accettato tutti i termini e le condizioni di utilizzo del servizio indicate nel presente documento. L’effettuazione del primo utilizzo del servizio costituirà ulteriore implicita accettazione da parte dell'utente delle condizioni contenute nel presente documento.
5. In nessun caso il Comune di Padova può essere ritenuto responsabile del mancato e/o inesatto adempimento da parte dell'utente di ogni eventuale procedura di legge e regolamento in relazione all’uso del servizio.

2. Erogazione del servizio

1. Il Comune di Padova non offre alcuna garanzia e non è obbligato in alcun modo circa la qualità del servizio, in particolare con riguardo alla tenuta, bontà e perdurare dei collegamenti.
2. Il Comune di Padova si riserva il diritto di sospendere e/o interrompere e/o variare, in qualsiasi momento e senza onere di preavviso, il servizio e non potrà comunque essere considerato responsabile nei confronti sia dell'utente che di terzi per la intervenuta sospensione ovvero interruzione. In tal caso, l’utente non potrà vantare diritti all'utilizzazione del servizio.
3. Il Comune di Padova potrà integrare e/o modificare unilateralmente, in qualsiasi momento e senza preavviso, le condizioni e i termini del presente documento. Le eventuali modifiche e/o integrazioni potranno essere comunicate all'utente, tramite comunicazione sulla pagina di login e opportunamente pubblicate nel sito web Padovanet. La continuazione nell'utilizzo del servizio successivamente alla comunicazione implica di fatto l'accettazione delle nuove condizioni.

3. Impegni ed obblighi dell'utente

1. Il Comune promuove un atteggiamento collaborativo degli utenti e raccomanda il rispetto delle norme di “buona educazione” in uso sulla rete Internet, note come "Netiquette" divenute standard nel documento noto come "RFC 1855" (http://www.rfc-editor.org).
2. L'utente si impegna a non utilizzare il servizio per effettuare comunicazioni che arrechino danni o turbative ai servizi di rete o a terzi o che violino leggi e regolamenti vigenti. In particolare, in via esemplificativa e non esaustiva, l'utente si impegna a non scambiare in rete, attraverso il servizio, materiale in violazione della legge sul diritto d'autore, o di altri diritti di proprietà intellettuale o industriale.
3. L'utente si impegna a:
   • utilizzare il servizio per le finalità personali per cui è stato concesso, in particolare si impegna a non utilizzare il servizio per fini commerciali;
   • dotare il proprio apparato WIFI di adeguate protezioni contro virus o altro genere di intrusioni, che possano arrecare danni a terzi o alla stessa rete Padovaweb;
   • non inviare tramite posta elettronica messaggi pubblicitari e/o promozionali o comunicazioni ad altri utenti e/o gruppi di discussione senza che sia stato richiesto ed ottenuto il relativo consenso ovvero senza che tale invio sia stato sollecitato in modo esplicito(spam);
   • non trasferire grosse moli di dati;
   • non utilizzare strumenti (ad esempio peer to peer e sniffer) nelle aree di copertura che potrebbero influenzare negativamente le prestazioni della rete oltre che violare il diritto alla privacy degli utenti del servizio;
   • non trasmettere materiale e/o messaggi che incoraggino terzi a mettere in atto una condotta illecita e/o criminosa passibile di responsabilità penale o civile;
   • non immettere in rete informazioni che possano presentare forme o contenuti di carattere pornografico, osceno, blasfemo, razzista, diffamatorio, offensivo o che istighi alla violenza;
   • rispettare eventuali ulteriori regole e indicazioni operative che verranno date dal Comune di Padova.
4. L'utente si impegna a non occupare il canale radio per scopi diversi da quelli di ricevere il servizio di rete wireless fornito da Padovaweb, né tantomeno ad installare access point o ripetitori WIFI.
5. Il Comune di Padova si riserva il diritto di cessare l’erogazione del servizio unilateralmente e in qualsiasi momento, senza obbligo di alcuna motivazione, senza preavviso e senza alcun indennizzo, qualora determini, a suo insindacabile giudizio, che l'utente abbia violato anche solo uno degli obblighi qui indicati.

4. Responsabilità

1. L'utente è responsabile di ogni violazione delle presenti condizioni d'uso e si impegna a non utilizzare il servizio in modo improprio, in violazione di leggi, regolamenti o provvedimenti amministrativi e si assume ogni responsabilità in merito alla corretta fruizione del servizio. L’utente si impegna a tener indenne il Comune di Padova da qualsiasi pretesa e rivendicazione a qualsiasi titolo avanzate anche da terzi in relazione all’utilizzo del servizio.
2. L'utente si assume ogni responsabilità ed onere circa il contenuto e le forme delle comunicazioni realizzate tramite il servizio e si impegna a tenere indenne il Comune di Padova da ogni pretesa o azione di terzi, in conseguenza a tali comunicazioni. Con tale presa di responsabilità, l'utente esonera espressamente il Comune di Padova da qualunque responsabilità e onere di accertamento e/o controllo al riguardo.
3. L'utente s'impegna a tenere indenne il Comune di Padova da tutte le eventuali perdite, danni, costi e oneri, ivi comprese le eventuali spese legali, che dovessero essere sostenute dall’utente in conseguenza dell'utilizzo del servizio.
4. Il Comune di Padova non sarà responsabile verso l'utente e/o suoi aventi causa e verso terzi per i danni diretti, indiretti o consequenziali, comprese le perdite e i costi supportati in conseguenza a sospensioni o interruzioni del servizio.

5. Riservatezza

1. L'utente prende atto ed accetta che le frequenze radio ed il traffico di rete wireless potranno essere monitorate allo scopo di mantenere le prestazioni della rete wireless ad un livello adeguato oltre che per garantire il corretto utilizzo del servizio.

6. Trattamento dei dati personali

1. Il Comune di Padova, titolare dei dati forniti dall’utente ai sensi e agli effetti dell’art. 13 D. Lgs. 196/03, informa l’utente che i predetti dati saranno trattati con strumenti informatici e telematici idonei a garantirne la massima sicurezza e riservatezza, al fine esclusivo di fornire il servizio e che non verranno ceduti a terzi.
2. Il Comune di Padova non sarà in alcun modo responsabile del trattamento di dati di terzi posto in essere dall’utente attraverso il servizio.

7. Legge applicabile e foro competente

1. Le presenti condizioni d'uso sono disciplinate dalle legge italiana e comunitaria, ove applicabile. Per quanto non espressamente previsto nel presente documento si applicano le norme vigenti.
2. Per tutte le controversie che dovessero insorgere in relazione alle presenti condizioni d'uso, incluse le controversie nell'interpretazione, efficacia, validità ed esecuzione, sarà competente in via esclusiva il Foro di Padova.
3. Nel caso in cui alcune disposizioni contenute nelle presenti condizioni d'uso fossero ritenute nulle e/o invalide e/o inefficaci le restanti dovranno comunque ritenersi pienamente valide ed efficaci.

These general conditions define and govern the terms and conditions under which the Municipality of Padua offers to the citizens the wireless network service, called Padovaweb.

This Agreement is subject to Italian law.

This Agreement is drawn up in Italian language and the Italian text is the only one that will prevail, even if, for convenience of the Parties, has been translated into English. In case of dispute, the Italian text is the only one that will prevail, and the only language of the proceedings will be the Italian.

1. Description and characteristics of the Service

1. The Service Padovaweb (hereinafter Service) allows you to access free of charge, without any charge and / or installation cost to the user, to the Internet in Wi-Fi mode (Wireless Fidelity) , only in specially-city areas.
2. The Service can be used by the user, whether or not resident in the city of Padua, with their portable devices (PC, smartphone, etc.) compatible and with certified WiFi network card; appropriately configured. Therefore it remains with the user responsibility to equip himself, at his own expense, with the technical equipment necessary to access the Service.
3. The Service is provided with the safety requirements applicable, through the use of shared band frequencies and without protection from interference: thus providing the Service and its quality is not guaranteed. The Service is provided with free network and it is not protected by encryption of traffic. It is therefore not recommended for use in cases of communications containing confidential data.
4. Upon connection, the user must have carefully read and expressly accepted all the terms and conditions of the Service indicated in this document. The results of the first use of the Service will further imply the acceptance by the user of the conditions contained in this document.
5. Under no circumstances the Municipality of Padua can be held liable for the failure and / or improper fulfillment by the user of any legal procedure and regulation in relation to the use of the Service.

2. Service delivery

1. The Municipality of Padua does not guarantee and is not obligated in any way about the quality of Service, in particular with regard to the goodness and persistence of the connections.
2. The Municipality of Padova reserves the right to suspend and / or stop and / or change, at any time and without prior notice, the Service and shall in no case be considered responsible to both the user and third parties for the suspension or interruption occurred. In this case, the user will not have any right to use of the Service.
3. The Municipality of Padua will complement and / or modify unilaterally, at any time and without notice, the terms and conditions hereof. And modifications and / or additions may be provided to the user, through communication on the login page and duly published in Padovanet website. The continued use of the Service after the statement implies de facto acceptance of the new conditions.

3. User commitments and obligations

2. You agree not to use the Service to make communications that may cause damage or disruption to network services or third parties or that violate laws and regulations. 3. You is committed to
   • use the Service for personal purposes for which it was granted, in particular undertakes not to use the Service for commercial purposes;
   • equip your WIFI device with adequate protection against viruses or other types of intrusions, that can do damage to third parties or the same Padovaweb network;
   • do not send e-mail advertising and / or promotional messages or communications to other users and / or discussion groups without having been requested and obtained their consent or without such submission had been solicited (spam);
   • not transfer large amounts of data,
   • do not use tools (such as peer to peer and sniffer) in coverage areas that could adversely affect network performance as well as violating the right to privacy of users that are using the Service;
   • not transmit material and / or messages that encourage third parties to enact improper conduct and / or criminal rise to criminal or civil liability;
   • not input in the network information that may present forms or content that is pornographic, obscene, profane, racist, defamatory, offensive or instigates violence,
   • comply with any additional rules and operational guidelines that will be given by the Municipality of Padua.
4. You agree not to occupy the radio channel for any purpose other than to receive the wireless network service provided by Padovaweb nor to install access point or WIFI repeaters.
5. The Municipality of Padova reserves the right to discontinue the Service unilaterally and at any time, without obligation to any kind, without notice and without compensation, if it determines, in its sole judgment, that the user has violated even only one of the obligations set forth herein.

4. Liability

1. The user is responsible for any breach of these terms of use and will not improperly use the Service, in violation of laws, regulations or administrative measures and assumes full responsibility for the proper use of the Service. You agree to leave unscathed the Municipality of Padua from all claims and claim to any title also advanced by third parties in connection with your use of the Service
2. The user assumes all responsibility and burden on the contents and forms of communications made through the Service and agrees to leave unscathed the Municipality of Padua from all claims or actions of third parties, as a result of such behavior. 4. The Municipality of Padua will not be liable to the user and / or its assignees and to third parties for direct, indirect or consequential damages, including losses and costs supported as a result of suspension or discontinuance of the Service.

5. Confidentiality

1. You acknowledge and agree that the radio frequency and wireless network traffic can be monitored in order to maintain the performance of the wireless network at an appropriate level and to ensure the proper use of the Service.

6. Privacy policy

1. The Municipality of Padua, owner of the data you provide in accordance with and in application of art. 13 of Legislative Decree no. 196/03, informs you that the aforementioned data will be processed using computer and electronic instruments that guarantee maximum security and confidentiality, for the exclusive purpose of providing the Service and that will not be disclosed to third parties.
2. Municipality of Padua will not be in any way responsible for the third parties data processing set up by the user through the Service.

7. Governing Law and Jurisdiction

1. The present conditions of use shall be governed by Italian and EU law, where applicable. For what not expressly stated in this document, current regulations will be applied.
2. For all disputes arising in connection with these Terms of Use, including disputes in the interpretation, effectiveness, validity and performance, it will be referred exclusively to the court of Padua.
3. In the event that certain provisions contained in these terms and conditions are void and / or invalid and / or ineffective, the remaining must still be considered valid and effective.
